A.1 About Us

 ("Website") is owned and operated by QUAVA ("we", "us", or "our"), a sole proprietorship firm registered in India, with its registered office at 11/418, Kollam, Kerala- 690538.

A.2 Acceptance of Terms
By accessing, registering on, or transacting through our Website or App, you ("User") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, you must immediately discontinue use of the Website.

A.3 Eligibility
You must be at least 18 years of age and legally competent to enter into contracts under the Indian Contract Act, 1872, to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements. We reserve the right to terminate your account if we discover you do not meet these requirements.

A.4 Modification of Terms
We reserve the right to modify these Terms at any time without prior notice. Changes will be posted with an updated effective date. Your continued use of our Services following any changes constitutes your acceptance of the modified Terms.

B. User Account

B.1 Registration
To access certain features, you may be required to create an account. You agree to:
Provide accurate, complete, and current information.
Maintain the confidentiality of your account credentials.
Notify us immediately at info.houseofquava@gmail.com
 if you suspect unauthorised access to your account.
Accept responsibility for all activities that occur under your account.

B.2 Account Termination
We reserve the right to suspend or permanently terminate your account without prior notice if you provide false information, engage in fraudulent or abusive activity, or violate any provision of these Terms. Upon termination, your right to access the Services will immediately cease.

C. Products, Pricing, and Orders

C.1 Product Descriptions
We make every effort to accurately display the colour, texture, and dimensions of our products. However, actual colours may vary slightly based on your device's display settings. Our products are crafted with care and may exhibit minor variations characteristic of artisanal work, which do not constitute a defect.

C.2 Pricing
All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes (including GST) unless stated otherwise. We reserve the right to change product prices at any time. In the event of a pricing error due to a technical glitch, we reserve the right to cancel the affected order and issue a full refund.

C.3 Order Placement and Confirmation
An order placed on our Website constitutes an offer to purchase at the stated price. Your order is confirmed only upon receipt of a confirmation email and/or WhatsApp message with your Order ID. We reserve the right to refuse or cancel any order due to product unavailability, suspected fraud, pricing errors, or incorrect delivery information.

C.4 Order Cancellation by User
You may cancel your order before it has been dispatched from our warehouse by contacting Customer Support at info.houseofquava@gmail.com
 or WhatsApp at +91 7208336760. Once dispatched, orders cannot be cancelled. Please refer to Section F (Exchange & Refund Policy) for post-delivery options.

D. Payment Terms
We accept the following payment methods:
Credit cards and debit cards (Visa, MasterCard, RuPay, American Express).
UPI (Google Pay, PhonePe, Paytm, etc.).
Net banking.
Digital wallets as listed on the checkout page.
All transactions are processed through PCI-DSS compliant third-party payment gateways. By providing payment information, you confirm you are authorised to use the payment method and that the information is accurate.

E. Shipping Policy
We ship across India. Upon dispatch, you will receive a shipping confirmation with a tracking number via email and WhatsApp.
Delivery timelines: 5–8 business days for metros; 8–12 business days for other locations. Timelines may vary due to public holidays, natural calamities, or courier delays.
Shipping charges are as displayed at checkout and vary based on order value and delivery location.
Risk of loss for products passes to you upon delivery by our logistics partner.
We are not liable for delays caused by third-party logistics partners, force majeure events, or incorrect shipping information provided by you.

F. Exchange & Refund Policy

F.1 No Refund Policy
All sales made on the Website are FINAL. We do not offer monetary refunds under any circumstances once a product has been shipped, including but not limited to:
Change of mind or personal preference.
Items purchased during sale events, flash sales, or on special discounts.
Items that do not meet your subjective style expectations.
By placing an order on our Website, you explicitly acknowledge and accept this No Refund Policy.

F.2 Size & Style Exchange — 5-Day Window
Because we understand that finding the right fit in plus-size fashion can be a journey, we offer a ONE-TIME size or style exchange within 5 (five) calendar days from the date of delivery, subject to the eligibility conditions listed in Section F.3.
In case of a price difference, the balance amount will be payable by the customer, or any excess amount will be refunded accordingly.
Exchange Window: 5 calendar days from the date of delivery
Exchange Type: Different size of the same style or another style
Frequency: ONE-TIME per order item

F.3 Conditions for Exchange Eligibility
To be eligible for a size/fit exchange, ALL of the following conditions must be met:
The exchange request must be raised within 5 calendar days of the delivery date as confirmed by our logistics partner's tracking system.
The product must be unworn, unwashed, and in its original condition with all original tags intact and attached.
The product must be returned in its original packaging with the invoice/packing slip enclosed.
The product must not show any signs of use, perfume/deodorant stains, cosmetic marks, or damage caused after delivery.
Proof of purchase (Order ID and delivery confirmation) must be provided.
An unboxing video and delivery photo may be required where the condition of the item is disputed.

F.4 Items NOT Eligible for Exchange
The following categories are strictly not eligible for exchange:
Products purchased during sale events, festival offers, flash sales, or with promotional discount codes.
Innerwear, shapewear, swimwear, bodysuits, and intimate apparel (for hygiene reasons).
Accessories including jewellery, bags, belts, hair accessories, and scarves.
Products that have been customised, tailored, or altered at the customer's request.
Gift cards and vouchers.
Products with removed tags, visible wear, staining, or any form of damage post-delivery.

F.5 How to Initiate an Exchange
To request an exchange, please follow these steps:
Step 1: Email us at info.houseofquava@gmail.com
 or WhatsApp us at +91 7208336760 within 5 days of delivery, quoting your Order ID.
Step 2: Share clear photographs of the product with all tags visible, along with your reason for exchange.
Step 3: Our Customer Care team will confirm eligibility within 2 business days.
Step 4: Upon approval, you will receive reverse pickup scheduling confirmation. Reverse pickup charges, if applicable, will be communicated at this stage.
Step 5: The replacement product will be dispatched within 3–5 business days of receiving the returned product at our warehouse, subject to stock availability.
If the requested size is unavailable, we will issue Store Credit equal to the original product value, valid for 6 months from the date of issuance.

F.6 Defective or Damaged Products
If you receive a defective, damaged, or incorrect product, you must notify us within 24 hours of delivery by emailing info.houseofquava@gmail.com
 with your Order ID and clear photographs and an unboxing video showing the defect. Upon verification, we will arrange a replacement at no additional cost. If a replacement is unavailable, we will issue full Store Credit.
PLEASE MAKE AN UNBOXING VIDEO WHILE OPENING THE PACKAGE AND CHECK YOUR ARTICLE THOROUGHLY IN THAT VIDEO. FOR ANY EXCHANGE AND RETURN DUE TO DAMAGED PRODUCT, THE UNBOXING VIDEO WILL BE MANDATORY.
We reserve the right to reject claims that do not meet the above conditions or appear to be fraudulent. All fraudulent exchange attempts will be reported to relevant authorities.

G. Intellectual Property
All content on the Website and App, including text, graphics, logos, product images, brand name, design elements, and software, is the exclusive property of QUAVA and is protected under the Trade Marks Act, 1999 and the Copyright Act, 1957.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for personal, non-commercial purposes only. You may not copy, reproduce, republish, or distribute any content from our Website without our prior written permission.

H. User Conduct and Prohibited Activities
You agree not to use our Website to:
Post, transmit, or distribute any content that is unlawful, defamatory, obscene, threatening, or violates any third-party rights.
Engage in fraudulent activity, including placing false orders, submitting fabricated exchange claims, or misrepresenting your identity.
Attempt to hack, disrupt, or gain unauthorised access to our systems, servers, or databases.
Use any automated tools, bots, or scrapers to extract data from the Website without our consent.
Use our platform in any manner that violates applicable Indian law, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019.
We reserve the right to suspend or terminate your account and pursue legal action in the event of any violation.

I. Disclaimer and Limitation of Liability
Our Services are provided on an "as is" and "as available" basis without any warranties, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including fitness for a particular purpose and non-infringement.
We shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use our Services, delays in delivery, unauthorised access to your data, or errors in product information. Our aggregate liability for any claim shall not exceed the amount paid by you for the specific product in dispute.

J. Governing Law, Jurisdiction, and Dispute Resolution
These Terms shall be governed by the laws of India. In the event of any dispute, the parties shall first attempt to resolve the matter amicably within 30 days. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Kollam, India.

K. Severability and Assignment
If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. You may not assign your rights or obligations under these Terms without our prior written consent.

L. Effective Date
These Terms and Conditions are effective from April 26, 2026 and supersede all previous terms published by the Company.
